This document (and any other document mentioned herein) regulates the terms and conditions governing this website and the purchase of products or services therein (hereinafter the Conditions).

Irrespective of having read these Conditions before, whenever accessing, browsing, and/or using the website, the User (also referred to interchangeably as the Customer) undertakes to read the Legal Notice, Privacy Policy and Cookies Policy along with these Sales Conditions. On using this website or buying a product and service from it, the User is bound by these Conditions and the texts referred to above.

THE USER

The access, navigation and use of the website confers the status of User, who agrees to accept this status from the moment they engage in any of these actions. The User declares that they are over the age of 18 and that they have sufficient legal capacity to formalize contracts through this website.

GUARANTEE

All the products on the website are completely original, designed and produced by Clara Niubò and her team. All the material used has been purchased locally.

PURCHASING PROCESS

Users can shop on the website through the usual methods and processes. You should follow the established purchasing process whereby you add however many items you wish to a cart, basket or final purchase page. Users are required to complete and verify the information requested in each step to process their purchase. Users will then receive an email informing them that the purchase request has been received correctly as a confirmation of their purchase. At the time of the purchase, the User acknowledges that he/she understands and accepts the particular conditions of the product in question, that all the products are hand-crafted and hence each has its own idiosyncrasies. The personal data of the User will only be used for shipping the product/s purchased.

AVAILABILITY

You are informed that not all the products featured on the Clara Niubò website are available at all times, as each product is made individually. If there are any difficulties in delivering the order due to low stock, the customer will be informed by email and given an approximate delivery date for the product and/or a replacement, and if they do not accept this alternative they will be reimbursed with the amount in question.

PRICES AND PAYMENT METHODS

You are informed that not all the products featured on the Clara Niubò website are available at all times, as each product is made individually. SHIPPING AND DELIVERY

When the order consists of customized pieces or different pieces from those in stock, the delivery time will vary according to their specification.

In cases when it is necessary to make a physical delivery of the purchase, deliveries can be made to the Spanish mainland and the Balearic Islands. For the purposes of these Conditions, the delivery will be considered to have taken place at the time when the User or a third party nominated by him/her takes material possession of the product/s, accredited by a signature at the time of receiving the goods at the address agreed between the parties. If the delivery address is outside the abovementioned territory, please send an email to hola@claraniubo.com and we will contact you as soon as possible.

All purchases are subject to a set fee of 10 euros per delivery.

RETURNS/CHANGES:

As these are handcrafted products and special pieces made for you, we cannot accept any returns or changes. In the event of any damage to the item during transport, the User should send an email to hola@claraniubo.com no later than five days after delivery. The Customer should return the item in its original packaging and pay for shipping charges. The piece will then be returned to the customer in a perfect condition and Clara Niubò will reimburse the shipping charges. Any returns that are notified or sent outside the deadline given above may be rejected. The User is aware of this situation and accepts it at the time of making the corresponding purchase.

PROTECTION OF PERSONAL DATA

Clara Niubò is fully compliant with data protection law, specifically Organic Law 15/1999 of 13 December 1999 on the Protection of Personal Data, together with Royal Decree 1720/2007 of 21 December 2007 approving the Regulations for enforcing the abovementioned Law. In the context of the company’s activities, this website offers Users the option, among others, of registering to receive communications by email. The data resulting from this registration will be recorded on a data file in order to be able to inform Users of new features on the website and the different services offered by Clara Niubò. Users are hereby informed that Clara Niubò guarantees that their data will not be shared with third parties without their prior consent. Users freely and unequivocally accept that by using this website their data will be processed by Clara Niubò to conduct statistical studies and to send messages, news and publications related to content of this website. Clara Niubò guarantees at all times that Users have the rights of access, rectification, cancellation, information and opposition to the processing of their data, depending on the content of the regulations in force in this respect. RESPONSIBILITY

Clara Niubò cannot accept any responsibility for (i) losses not attributable to breach of contract by the company; (ii) business losses; (iii) technical errors due to fortuitous reasons or any other characteristic that prevents the correct operation of the website; (iv) inability to use the website due to maintenance that prevents access to it; (v) any noncompliance or delay in compliance with any of the obligations adopted when this is due to reasons that are beyond its reasonable control; in other words, those that are justified by force majeure.

INTELLECTUAL PROPERTY

The contents of this website, including images, the domain name, and articles, among others, are the property of Clara Niubò and are protected by Articles 8 and 32.1 of the Intellectual Property Law. In this respect, Users and/or Customers are strictly forbidden from copying, reproducing, selling, transmitting, distributing, modifying or showing for commercial use any of this content without the express written authorization of their owner. Users also undertake to respect the Intellectual and Industrial Property Rights of Clara Niubò. Users may view the contents of this website, print them, copy them and store them on their own hard drive or any other physical support provided that this is exclusively for their personal and private use.

AGREEMENT

MODIFICATION OF THESE CONDITIONS

Clara Niubò is entitled to modify these Sales Conditions at any time. The validity of these conditions applies according to their exposure, and hence they will be valid until modified by other conditions duly published by Clara Niubò.

APPLICABLE LAW AND JURISDICTION

The relationship between Clara Niubò and the User/Customer is governed by the provisions of current Spanish legislation and any disputes thereto will be subject expressly to the Courts and Tribunals of the City of Barcelona.
